TCS Layoff – What employees should do?
Do Not Resign,
only other option TCS got is termination or allow employee to continue
What could be the reasons for termination?
lowest performance rating in TCS is E
But TCS terminating even from B, C, D ratings – it is unfair termination
Even employees with lowest rating should be given chance to improve – if not, it is unfair termination
2. skill mismatch
Employees should be given chance to update skill – if not, it is unfair termination
Unfair termination can be challenged in labour department
Compensation for termination is larger than what TCS offers now
As per Industrial Dispute Act compensation is equal to salary of 3 months + 15days /year of service
for eg: an employee of 10 years experience should get 3 + (15days x 10) = 8 months salary (includng all allowances, not just basic)
So by resigning, you have only to lose.
